These Terms & Conditions govern the use of sensocollective.com, the placing of orders through the website and the contractual relationship arising from purchases made through our online store.

By accessing the website, creating an account, where applicable, or placing an order, you confirm that you have read and understood these Terms & Conditions and agree to be bound by them.

Nothing in these Terms & Conditions is intended to restrict or exclude any rights granted to consumers under applicable law.

Throughout these Terms & Conditions, the expressions “SENSO Collective”, “we”, “us” and “our” refer to BMJ GRUP SRL, as operator of the SENSO Collective brand and online store.

The expressions “customer”, “you” and “your” refer to any person accessing the website or purchasing products through it.

2. Scope of These Terms

These Terms & Conditions apply to all purchases made through sensocollective.com.

Our collections may include clothing, bags, stickers, decorative objects, accessories and other lifestyle products made available from time to time under the SENSO Collective brand.

Certain products may also incorporate personalised elements or features connected to the SENSO concept. Where specific conditions apply to a particular product, these will be clearly communicated on the relevant product page or during the ordering process.

3. Use of the Website

You may use sensocollective.com for personal and lawful purposes.

You agree not to use the website in any manner that may:

• interfere with its normal operation or security;
• infringe the rights of SENSO Collective or any third party;
• involve fraudulent, unlawful or abusive activity;

Such variations do not affect your statutory rights where a product does not conform to the description or characteristics agreed at the time of purchase.

We reserve the right to update product descriptions, specifications and availability where necessary.

5. Prices

All product prices are displayed in Romanian Lei (RON) unless otherwise stated.

The price applicable to your purchase is the price displayed at the time the order is placed, subject to the correction of obvious technical or typographical errors in accordance with applicable law.

Any applicable delivery charges will be clearly displayed before the order is completed.

Promotional prices, discount campaigns and special offers may be subject to specific conditions and validity periods, which will be communicated alongside the relevant promotion.

6. Placing an Order

Products may be selected and added to your shopping cart through the website.

Before submitting an order, you will have the opportunity to review the selected products, quantities, delivery information, applicable charges and total amount payable.

It is your responsibility to ensure that the information provided when placing an order is complete and accurate.

Submitting an order constitutes your request to purchase the selected products.

The distance contract is concluded when SENSO Collective confirms its acceptance of the order on a durable medium, in accordance with applicable legislation.

An automatically generated acknowledgement confirming that an order has been received may not, by itself, constitute acceptance of the order where it is clearly identified as an automated acknowledgement.

7. Order Availability and Cancellation

All orders are subject to product availability.

In exceptional circumstances, we may be unable to fulfil an order, including where:

• a product is no longer available;
• an obvious pricing or technical error has occurred;
• the information provided for the order is incomplete or incorrect;
• the payment cannot be successfully processed;
• there are reasonable grounds to suspect fraudulent or unlawful activity.

Where an order that has already been paid cannot be fulfilled, any amount due to the customer will be reimbursed in accordance with applicable legislation.

8. Payment

Products purchased through sensocollective.com may be paid for using the payment methods displayed at checkout.

Online card transactions are processed through the payment service provider integrated into our online store.

SENSO Collective does not store your complete payment card details.

Before submitting your order, you will be able to review the total amount payable, including any applicable delivery charges.

For online payments, the order will proceed following successful authorisation of the payment transaction.

9. Delivery

At present, SENSO Collective delivers exclusively within Romania.

Orders are dispatched by courier to the address provided during the ordering process.

Delivery is complimentary for orders with a minimum value of RON 350.

For orders below RON 350, the applicable delivery charge will be clearly displayed before checkout is completed.

Estimated delivery times will be communicated during the ordering process. These estimates may vary during peak periods, promotional campaigns or as a result of circumstances beyond the reasonable control of SENSO Collective.

Once an order has been dispatched, tracking information will be provided where this functionality is made available by the courier.

Customers are responsible for ensuring that the delivery address and contact information supplied with the order are accurate and complete.

10. Right of Withdrawal and Returns

If you change your mind about an online purchase, you have the right to withdraw from the contract and return eligible products within 14 calendar days from the date on which you, or a third party designated by you other than the carrier, takes physical possession of the goods, subject to the exceptions provided by applicable legislation.

You are not required to provide a reason for exercising your statutory right of withdrawal.

To exercise this right, you must communicate your decision to withdraw through a clear statement using the contact details provided on our website.

Following notification of withdrawal, the goods must be returned within the period prescribed by applicable law.

Products may be handled only to the extent reasonably necessary to establish their nature, characteristics and functionality. You may be responsible for any reduction in value resulting from handling beyond what is necessary for such an assessment.

Returned products should include all components and accessories originally supplied with them, where applicable.

The direct cost of returning the goods is borne by the customer, except where the product is non-conforming, has been supplied incorrectly by SENSO Collective or where applicable law provides otherwise.

In the event of a refund, the invoiced amount due for reimbursement will be refunded within a maximum of 14 calendar days, in accordance with applicable legislation.

Where only part of an order is returned, the refund will correspond to the amounts legally due in respect of the returned products and any other amounts required to be reimbursed by law.

Refunds will generally be made using the same payment method used for the original transaction, unless otherwise expressly agreed.

SENSO Collective may withhold reimbursement until the returned goods have been received or until you provide evidence that the goods have been sent back, whichever occurs first, where permitted by law.

11. Personalised Products

The statutory right of withdrawal does not apply, in the circumstances provided by law, to goods made to the consumer's specifications or goods that are clearly personalised.

This may include products physically created or modified specifically for the customer using individually selected text, imagery, artwork, dimensions or other personalised characteristics.

A product will not be treated as personalised solely because it includes a standard feature offered generally to SENSO Collective customers where that feature does not make the physical product individually manufactured or clearly personalised for that customer.

The exclusion of the right of withdrawal for a personalised product does not affect the customer's statutory rights where the product is non-conforming.

12. Product Conformity

Products sold by SENSO Collective are subject to the statutory requirements relating to conformity of goods.

Where a product has a lack of conformity that existed at the time of delivery, customers are entitled to the remedies provided by applicable consumer protection legislation.

Depending on the nature of the product, examples of non-conformity may include:

• manufacturing defects in the material;
• defective stitching, assembly or construction;
• prints, applications or graphic elements that do not correspond to the product ordered;
• products received damaged or presenting defects existing at the time of delivery;
• significant discrepancies from the characteristics, dimensions or description presented on the website;
• failure of a product to function as intended, where the product has a specific functional purpose.

Normal wear and tear or deterioration resulting from inappropriate use does not, in itself, constitute a lack of conformity.

This may include, depending on the product:

• natural wear resulting from ordinary use;
• fading or deterioration caused by failure to follow washing or care instructions;
• tearing, cutting, snagging, impact or other accidental damage;
• damage to bags caused by overloading or inappropriate use;
• damage to stickers or adhesive products caused by application to unsuitable surfaces, incorrect installation or exposure to conditions inconsistent with their intended use;
• damage caused by excessive heat, water, chemicals or other external factors where the product was not designed for such conditions;
• normal aesthetic changes resulting from use over time.

If you believe that a product is non-conforming, please contact us using the details available on the website and provide your order number, the product concerned, a brief description of the issue and, where useful, relevant photographs.

Confirmed cases of non-conformity will be addressed in accordance with the remedies available to consumers under applicable law.

13. SENSO Digital and Personalised Content

Where a SENSO Collective product allows the customer to associate, upload, select or manage personalised digital content, the customer remains responsible for the content they choose to use.

You must ensure that any text, photographs, images, audio, artwork or other material submitted or associated with a SENSO feature:

• belongs to you or is used with the necessary permission;
• does not infringe copyright, trademark, privacy, personality or other third-party rights;
• is not unlawful, fraudulent, defamatory or otherwise prohibited by applicable law;
• does not contain malicious software or material intended to interfere with the operation of the service.

Where technically and legally necessary, SENSO Collective may restrict or remove content that infringes these requirements.

The customer retains any rights they hold in their original content. To the extent necessary to provide the requested functionality, the customer authorises SENSO Collective and its technical service providers to process that content solely for the operation and provision of the relevant service, subject to our Privacy Policy and applicable law.

14. Intellectual Property

The SENSO Collective name, visual identity, product designs, graphics, photographs, texts, layouts, concepts and other original content displayed on sensocollective.com are owned by or lawfully used by BMJ GRUP SRL and are protected by applicable intellectual property legislation.

Access to the website does not grant users any ownership or intellectual property rights over its content.

Unless expressly permitted in writing, website content may not be copied, reproduced, adapted, distributed, published, commercially exploited or used to create derivative works.

Products purchased from SENSO Collective may, of course, be used and resold by their lawful owners in accordance with applicable law. Purchasing a physical product does not transfer intellectual property rights in the underlying artwork, branding or design.

Nothing in these Terms & Conditions excludes or limits any liability or consumer right that cannot be excluded or limited under mandatory legislation.

21. Force Majeure

Neither party will be liable for a failure or delay in performing an obligation where such failure or delay results from an event qualifying as force majeure under applicable law.

Where such circumstances affect an order, SENSO Collective will take reasonable steps to inform the customer and to minimise the impact wherever possible.

22. Complaints

Customer satisfaction and the quality of the SENSO Collective experience are important to us.

The use of an alternative dispute resolution procedure does not restrict a consumer's right to seek legal remedies before the competent courts.

24. Applicable Law

These Terms & Conditions and contracts concluded through sensocollective.com are governed by Romanian law.

Where the customer qualifies as a consumer, this choice of law does not deprive them of any mandatory protection afforded by legislation that is applicable to them.

Any dispute that cannot be resolved amicably will be submitted to the competent courts determined in accordance with applicable law.

25. Amendments to These Terms

SENSO Collective may update these Terms & Conditions when necessary, including to reflect changes in our services, business operations or applicable legislation.

The version applicable to an order is the version in force at the time that order is placed.
